Traffic Stop Review the video (or transcript) of the actual traffic stop in Lawyer v. City of Council Bluffs from this unit’s study. Examine the subsequent search that was admitted as evidence in trial and considered by the appellate court. With the past nine weeks as background, what do you think of this event from a legal perspective? What do you think of this event from an ethical view? In posting your response, consider such issues as: • Are these perspectives in agreement or do they conflict? • What is the driver’s behavior? • What is the officer’s motive? • The officer’s training. (Does he have an ethical responsibility to understand relevant constitutional and statute law?) • The officer’s agency. (Does his agency have an ethical responsibility in this area?) • The partner’s behavior. (Does a particular sub-culture exist within the agency affecting this event?) • The effect of this event on the community. • As you reread the opinions of the trial judge and appellate court, consider whether the outcome might have been different if there were no video and the court had to rely solely on the parties’ descriptions of the events.
