Re: Statutory Research
Please report back to me regarding the following client matter. Be sure to submit your responses via the Blackboard course page by 11:59 p.m. on March 27, 2015.
Last month in Metropolis, U.S.A., a major protest was held challenging some proposed changes to some federal tax laws. Because the weather had been unusually warm, the number of people that gathered at the protest far exceeded the expectations of local law enforcement. Things got a bit out of control and at one point a small group of people started burning the U.S. flag and another group began stomping on another one. Police moved in and arrested several individuals and charged them with violating the federal Flag Protection Act. One of the protestors happens to be the son of one of your clients and he has posted bail but would like to see if the charges can be dropped. He feels that his sons constitutional rights of free speech were violated. Can you do some quick research and answer the following as we seek to have the case dismissed?
In conducting your research:
1.Briefly identify and explain the legal issue or question that needs to be addressed.
2.Identify your search terms that you will be using in conducting your research.
3.Describe your research steps and strategies.
4.Provide a conclusion based on your research.
5.Provide a brief analysis to why you have reached the results/recommendations in your conclusion. (Hint: Be sure to check the relationship between the statute and any court decision you may locate via Google Scholar or other means).
