I have a few related questions regarding my tax situation
Hello Sam,
I’m a Spanish citizen that lived 25 years in the UK and returned to live in Spain on April 2011.
I
have savings and receive interest from UK banks, some with the tax
retained at 20% and some paid gross. I filed a P85 with HMRC when I left
the country and sent R105’s to the banks (although many didn’t accept
it -they say they don’t have to).
I have a few related questions regarding my tax situation.
1-
What is the right procedure to file my tax return and to recover the
tax in the UK as I’m now a Spanish resident. Do I have to file an SA
100 and SA 109? or fill an SA 100 and then an R 43. Can I claim the
personal allowance? Will I recover all the tax I paid or just a
percentage of it (I have read somewhere that they may keep 10 or 12% of
the taxes anyway).
If the SA 100 and SA 109 is the way, do I have to file as well the helpsheet 302 or 304- which one?
I
have also come across another form (Spain Individual) for relief at
source and repayment of UK tax under the Double taxation Convention. Is
this relevant for my situation?
And finally in year 2011/12 I
only did the SA 100, depending the response above, will I have to amend
and resubmit the proper SA forms?
