How do changes in the law address the needs of society?
In the Session 1 lectures, I talked about how the law changes slowly. This is because the law changes as society changes its values. For example, most states did not have dram shop laws prior to the mid-1980s. Dram shop is the law that holds bar owners responsible for injuries to an innocent third party (a person who is not a customer) that were caused by an intoxicated patron. The bar owner is held liable (responsible) if they serve the visibly intoxicated patron that injured the innocent third party. Each state is a little different with respect to their dram shop laws, and we will discuss this in a later session. I just want to use this as an example of how the law has changed as society has changed its values.
I bet you can think of a lot more situations where the law has changed to reflect changes in society’s values. In this discussion, I want you to think (and research) some changes in the law due to changes in society’s values. Laws can also change due to economic or emergency circumstances. In fact, we have seen lots of changes in our industry due to COVID-19. Find a situation where you think the law has changed to reflect changes in society’s values.
