CASE ANALYSIS
Select a case that represents a topic of interest that has been or will be covered in
the course material.

Cases are included in this text as a means of teaching legal principles and concepts.
As a general rule, cases are included in chapters where the legal concepts are
covered in relative detail.

You may select a case from the text, however, you will still need to go online and
read the unabridged case, since these cases are very abbreviated.

Please adhere to the following format in the written material prepared for submission
when analyzing cases:

1. Identify the case citation: the name of the case ie. parties involved
the date of the decision
the court that decided the case
2. Discuss the relevant facts of the case briefly. Do not copy the facts from the
case, but glean important information and include in a synopsis of the case.
3. Identify the issues presented in the case. The issues are generally rules of law,
but sometimes can be factual or procedural issues.
4. Give the holding of the case. This is usually discussed the judgment section of
each case.
5. Discuss the rational for each holding “in your own words”. What reasons the
court gave as a basis for the decision.
6. Do you agree with the holding(s) of the case? Discuss this section in some
detail, and why.

Format of your written material:

Your analysis must be typewritten and 1 and 1/2 line spaced.

No larger than 12 point type, no smaller than 10 point

It should not be more than five(5) typed pages, nor less than three (3) in length.

You must include either the scanned unabridged case with your analysis or a
link to the case in your submission.
