A man named John Casper was walking in Cardiff Bay, during a Saturday evening, when he suddenly saw three apparently drunk people singing in a nearby road. Having realised that one of them was the famous actor George Hanson, the man pulled out his mobile phone and took a series of pictures in which Hanson was vomiting and unsuccessfully attempting to stand up.

 

As soon as he got home, Casper shared these pictures on Twitter, adding the following message: “Just seen George Hanson at his best! Advice: Alcoholics Anonymous is round the corner”. The message was immediately retweeted by more than 3000 people. A few hours later, a Facebook user, Anna Linten, created a new group on Facebook, called “Be yourself, not George Hanson”, inviting young people not to follow the actor’s example; hundreds of people participated in the online discussion, condemning Hanson’s abuse of alcohol. Eric Guy, a journalist for the online newspaper “Cardiff Today” wrote an article on the story, accompanied by the pictures taken by Casper.

 

The following day, the actor searched for his name on Google News. To his surprise, the first link pointed to the article posted on “Cardiff Today”. He immediately contacted Google and the publisher of “Cardiff Today”, asking for the removal of the article and the pictures, explaining that he was simply acting for a new episode of Dr. Who and that a filming crew was recording the scene from behind a wall. Google rejected the request, explaining that its news aggregator simply performs the automatic task of indexing available articles. “Cardiff Today” refused to remove the story and the pictures, arguing that it sought to protect the interest of the public.

 

Advise the actor on his legal entitlements, if any, vis-à-vis the other subjects involved in this case.
